Whether you are a Tenant, Buyer, Landlord or Vendor you are sure to have many questions during your moving process. That’s totally normal, moving is not always straight forward, however often the answers to your questions are straight forward. Other times they are less clear and so we thought we would put some Frequently Asked Questions together. You might find the answer to your question here, as I am sure you are most likely not the first to ask it!

How long does it take to get my deposit back after check-out?

This all depends on the condition you leave the property in. If there are damages that you as a Tenant are responsible for then we aim to inform you of costs within 10 working days with the remainder being released on that notification. If there are no issues, we aim to return your deposit in full within 10 working days. Please note that although we endeavour to release the deposit within that time frame, we must follow set procedures put in place by TDS with whom your deposit will be registered with when your tenancy commences.

Do we have to set up our own utilities and will the electric and water be on when we arrive at the property?

The answer to both of these questions is ‘yes’. You will have to contact the utility providers upon move-in and provide them with your information, but the utilities will be available straight away.

Who is my current electricity provider?

You can find this out online by visiting http://www.enwl.co.uk/home and inputting the property address details.

Is Wi-Fi available in the property upon move-in?

You need to contact your chosen broadband supplier and set this up yourself after moving in.

What is the current landline telephone number?

We do not have this information on our system, they can set up a brand new number upon move-in.

Why do we need to go through referencing?

To check affordability. Usually this includes a Landlord reference, if applicable, and Credit history check.

Will the property be clean upon move-in?

The property will have a clean after the checkout of the previous Tenant. If you wish to request a deep clean or for anything in particular to be changed, please do so at the point of your viewing.

Is my property managed by Thornley Groves or the Landlord directly?

This should be asked at the point of viewing with your Lettings Consultant.

Who should we contact if we have any maintenance issues during our tenancy?

You will be assigned contacts in our maintenance department that will be there for you if and when any issues arise. If your property is managed by the Landlord, you will need to contact them directly.

Why do I need a Guarantor?

There can be a number of reasons a guarantor is required but on the whole it would generally be if your income does not meet the required amount.

How many sets of keys will we be given?

You will be given one set of keys per Tenant.

What happens on move-in day?

You will receive this information from your assigned Lettings Administrator handling your tenancy. You will arrange an appointment to collect the keys and sign some paperwork from the local office to the area you are moving to. You will also pay the outstanding funds then (if not transferred beforehand). The appointment generally takes around 15 minutes and then you are free to go to the property.

Will someone come with me to the property upon move-in?

No, you will collect the keys from the local office to the area you are moving to and be provided with a detailed Inventory that you can then go to the property yourself with and highlight any immediate issues. By this time, you will know who your dedicated contacts are in our maintenance team and they will be available to assist you if need be.

What happens to my deposit?

The Agent or Landlord will register your Security Deposit into a government backed Tenancy Deposit Scheme within 30 days of the tenancy start date, this deposit is then released once you have vacated the property providing that you have met the terms of the Tenancy Agreement, there is no damage to the property and all rent and bills are paid up to date.

What are Right to Rent checks and who must be checked?

In line with the Immigration Act, it is a legal requirement to verify that a Tenant or other occupier can legally rent a residential property in England. Before the start of the Tenancy all occupants aged 18 and over must be checked that they have the right to rent; including those not named on the Tenancy Agreement. These checks are carried out during the referencing process.

What if I/we were to break the Tenancy early?

Unless a break-clause has been agreed between all parties prior to the Tenancy start date, the Landlord may agree to a ‘Managed Break’ allowing the current Tenant(s) to vacate and the property to be placed back onto the market for re-let. If agreed the current Tenant(s) are responsible for covering the cost of the Landlord’s re-letting and are still liable for rent and bills until a new Tenancy begins.

How old is the property? What is the age and condition of the boiler? Which way is the house facing for religious purposes and also garden direction?

This is information that you should ask during your viewing. Often we also add this information in the property description on brochures and online.

What are the interest rates for a mortgage at the moment?

This varies depending on deposit size (bigger deposit, better rate bracket) but in general they are very low at the moment – You are best speaking to one of our Mortgage Advisors about which rate best fits you.

Can Buyers who are purchasing with a residential mortgage (as they are purchasing for themselves to live in) complete whilst Tenants are still living in the property?

No, completion can only take place after the Tenants have vacated as Lenders and Solicitors will not move to exchange until the property is empty.

On the first day of buying Thornley Groves said to me ‘let’s find out what your budget will be’

  • The very first thing a buyer must consider when purchasing is budget and ensuring that there are cash funds or a mortgage in place, ready to proceed, when the right property comes up. We have a number of very helpful, independent brokers, from Lomond Capital, who offer free appointments and have access up to 90 lenders on the market! Our advisors will be able to provide you with a mortgage in principle with the best rates and will also confirm the exact budget you can search within.

On the second day of buying Thornley Groves said to me ‘are you looking for two bedrooms or three?’

  • There are a number of experienced Sales Consultants at Thornley Groves across our ten offices, who are available to discuss your specific search criteria and provide you with details of various available properties that you may be interested in.

On the third day of buying Thornley Groves said to me ‘let’s discuss which properties you’d like to see’

  • Our consultants will then arrange viewings at any of the properties you are interested in and provide any additional information you require.

On the fourth day of buying Thornley Groves said to me ‘let me know your offer and I’ll ask the vendor if they’ll agree’

  • Once you have found your dream property, we will put the offer forward to the vendor and negotiate the sale price on your behalf, ensuring all parties are happy with the final price agreed.

On the fifth day of buying Thornley Groves said to me ‘I’ll ask the solicitor to quote you their fee’

  • We work very closely with various reputable solicitors’ firms, who offer competitive rates and provide a superior service. Once the sale has been agreed, we can ask solicitors to provide you with a quote and then it is up to you to make the decision of who to instruct to progress your purchase!

On the sixth day of buying Lomond said to me ‘let’s discuss who the best lender for you will be’

  • Our financial advisors will then arrange an appointment with you to progress your mortgage application and decide on the best lender for your specific purchase, based on your financial position. Once you have decided on a suitable lender, your Broker will then advise you on what fees are payable. Usually the banks will request payment for the mortgage valuation from the outset upon submitting your full application.

On the seventh day of buying my solicitor said to me ‘Please pay for searches and the rest, I’ll oversee’

  • Once your solicitor has been instructed, you will then need to pay for searches. These can cause a delay within the conveyancing process and the sooner they are paid for, the quicker the searches can be requested and the less delays you will encounter. Our Sales Consultants will also oversee the sale from the date it is agreed, up until completion.

On the eighth day of buying my solicitor said to me ‘I’ve had a response to the last enquiry’

  • Once your solicitor has received search results, there may be a number of enquiries raised in relation to the property and the corresponding lease. The vendor’s solicitor will then respond to these enquiries and once your solicitor receives a satisfactory response, they can provide the report for you to review.

On ninth day of buying my solicitor said to me ‘the contracts are complete, so have your pen at the ready’

  • After reviewing the contract provided by your solicitor, you will need to sign the contract papers and return them to your solicitor.

On the tenth day of buying my solicitor said to me ‘we are ready to exchange, so please transfer the money’

  • An exchange and completion date will then be set. If you are buying using cash funds, exchange and completion can take place simultaneously. However, if you are purchasing with a mortgage, you will need to transfer your deposit funds to your solicitor for exchange and they will then draw down funds from your lender in readiness for completion, which can take up to five working days.

On the eleventh day of buying Thornley Groves said to me ‘your sale has completed and you can collect your key!’

  • As soon as we have received confirmation from the solicitors that completion has taken place, our consultants will contact you to confirm and have your keys ready for collection.

On the twelfth day of buying Thornley Groves said to me ‘do you need someone to manage your property?’

WHY WOULD A BUYER NOT BE INTERESTED IN BUYING YOUR PROPERTY OR WITHDRAW THE OFFER THEY MADE?

Thinking of buying or selling your property? Have you considered the pitfalls and the obstacles that prevent transactions from completing, or even being agreed!

Everyone sets out to buy or sell with the greatest intentions; some with previous experience and some without. Unfortunately, there is no rule book. Buying or selling can be daunting and a very stressful process from start to finish. As an Estate Agent we can help manage many difficult situations or maybe prevent them from becoming an issue. However, if there is something wrong with a property (as there is with most houses) we are able to help and guide clients through the process. We can arrange further reports, obtain costings and help both parties re-negotiate to a suitable compromise whilst keeping the sale moving forward.

The market is stronger than it has been for many years. Since the property crash in 2008, prices have increased rapidly, buyers and sellers make fast decisions which can create ‘buyer’s remorse’ and increase fall through rates. Therefore, being prepared and having your property ready and in good condition, with all the relevant documentation and certificates, will demonstrate that the product you are selling has no hidden surprises. Cheap can mean expensive in the long run and if a sale falls through there is the emotional disappointment, financial loss, and the horrible feeling of having to start over again and prepare your property for viewings.

Let’s take a look at what kind of issues could be a ‘deal breaker’ and at what point can a potential sale go wrong for you.

 What kind of things can actually prevent you from finding a buyer?

  1.  Presentation is key and you only get one chance to impress, so spending time getting your property ‘market ready’ is invaluable.
  2. Many buyers will make quick judgements based on what they see on the internet so make sure you have nice images.
  3. Make dark rooms look lighter with white paint or a mirror that reflects the little light there is.
  4. Tidy cluttered or untidy rooms.
  5. Scruffy gardens and paths full of weeds can really put buyers off.
  6. No parking, or no mention of parking in the initial description turns buyers off very quickly.
  7. Gardens not facing a sunny aspect. Try and take photos on a nice day so that this doesn’t look so unattractive.
  8. Bad smells and damp in a property is a big ‘no’ for buyers.
  9. Kitchen not big enough for a table? Try and have an alternative dining area if you haven’t already.
  10. Do you live at number 13? You may want to think about changing it to 12a!

What kind of problems can stop a transaction after a sale has been agreed?

  1.  Poor surveys probably equate for the majority of aborted sales or a surveyor down valuing the house price. This is where even the most experienced Estate Agent has little control, however, we work for the Vendor and it’s about not always putting your eggs in one basket. Keeping a reserve buyer interested and aware if a buyer withdraws, can protect our client. We can also help by chasing both solicitors, passing on and obtaining information for speed, keeping all parties up to date and dealing with other Estate Agents in the chain.
  2. Mortgages are the main source of funding and there are very few full cash buyers. A mortgage lender may insist on their own reports and a full home buyers survey or certain insurances if documentation is not satisfactory (which is an added cost for the seller). A mortgage offer may expire and not be extended meaning that the buyer would have to go through the credit process again. This can take time which can put a potential buyer off.
  3. Short leases can also be an issue which is something that a buyer may not have been aware of when making an offer, and consequently, the buyer, lender, or both may have an issue and withdraw if the lease cannot be extended.

With some careful planning and preparation, a lot of the problems can be avoided so why wait? Deal with these issues now!
